The Collapse of the 28-Clause Peace Proposal for Ukraine: Why Peace Negotiations Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the crisis sparked by the announcement of a new 28-point plan for achieving ceasefire appeared – temporarily – to have been contained. A Washington representative spoke of "significant advancement" after Ukraine-US talks in Geneva. On Monday night, the Kremlin made its retaliation: an extensive attack of missile and drone strikes on Kyiv.

The Pattern of Diplomacy and Destruction

The succession of contrasting events captured the harsh reality of the outgoing year. By day, diplomatic battles are fought: hopeful statements are delivered from various governments. Significant resources is expended on managing specific proposals. By night, Russian leadership brutally reminds the world that, for them, military action persists as the primary tool for achieving "resolution".

Nocturnal Warfare

As Russia's attack progressed into the early hours of Tuesday, the present situation of Ukraine's exposure was laid bare. Ukraine is able to track missile launches from across the border, a ability provided through timely intelligence. From vantage locations, defense planes that had been dispatched to intercept incoming guided weapons flew past – sophisticated military planes provided to Ukraine by European allies.

Soon thereafter, Kyiv's anti-aircraft weapons activated: several firings fired to intercept a Russian ballistic missile. This was a advanced protection mechanism at work, probably provided by partner states. Every firing creates sudden vibrations, shaking the windows. The moment of terror quickly gives way to sober acceptance: perhaps the approaching threat won't hit its mark this time, sparing the city from ruin and further power outages.

Persistent Threats

Not long after, a heavy machine gun engaged a drone close by, part of a rapid response unit – most likely allied-provided weaponry. Unfortunately, the projectiles didn't strike the enemy aircraft – it maintained course toward its destination.

Periodically, this carried on until dawn. Kyiv awoke to the early updates: multiple fatalities, destruction and utility failures in multiple buildings as a result of the night's assault. As typically, everyone still maintained normal activities – enduring hostilities. But those 24 hours illustrated Ukraine's vital need on international aid – a reliance that regional partners are clearly incapable to fill in the short term.

Ineffective Peace Efforts

The comprehensive proposal from American leadership sparked intense emotion, discussion and deep concern – and temporarily diverted attention from Ukraine's major integrity crisis in years. Yet, we have experienced comparable situations, after earlier high-level meetings and multilateral gatherings.

Every new initiative from Washington adheres to the same pattern: a negotiation push against Ukraine, which Kyiv, with other European capitals, succeeds in resisting. They manage the tension but never actually win the battle. This trend will, certainly, continue.

Strategic Calculations

It is convenient to criticize certain parties of persistently promoting Russian terms. But that does not seem to be the entire situation. Washington operates on a assumption well known to international relations experts: you cannot win at the negotiating table what you have been unable to protect through force. The American government believes that it is impossible to compel Moscow to surrender the land that it currently occupies in Ukraine's south or east.

The issue is that while recognising this factual reality, US leadership does minimal to discourage Russia, through statements or actions, from thinking that the current condition will not change more in its benefit in the near future.

Conflicting Perspectives

Therefore, Moscow is convinced that duration works to their advantage – that Ukraine and its partners are coming close to fatigue. Their incentive to agree to terms that does not give them the greatest potential benefit is almost completely absent. There may be multiple initiatives to end hostilities, but they will carry on as long as Russia's leadership remains completely certain in the conclusion.

On the contrary, Kyiv believes that Ukraine can still endure, gradually sacrificing people and territory but averting a entire defensive failure until circumstances change in its advantage.

Current Realities

Realistically, there are no real preconditions for a truce. Now, personal considerations are becoming relevant: personal goals to broker a ceasefire and obtain worldwide acknowledgment, and Ukrainian leadership's dual difficulties – on one hand, not to alienate a key ally, and on the other, to unite the population around the country's interests against any proposal Kyiv finds unworkable, so that their attention does not switch to domestic problems. And although their task will now be considerably more difficult after latest incidents, it remains quite doubtful that this will modify their basic position.

These two forces are guiding negotiations.

Summary and Prospects

It took a just a single week to kill the 28 points of the most recent proposal. Assertive and inconsistent approach of the matter by American leadership, pushback by Ukraine and the other European countries, along with soothing efforts of representatives, and finally, recent disclosures, all achieved their purpose.

While new proposals based on established approaches are imminent, Kyiv, London and other allied nations should arrive at a critical understanding: Ukraine and Europe will only be able to fend off negotiation assaults from Washington that are based on Russian demands and reflect particular unwillingness to modify developments, if they stand together and strengthen their defence capabilities at a significantly accelerated rate. If they do, neither external pressure nor military threats will be able to overcome them. In the meantime, Ukraine's ability to defend against evening bombardments will, for the predictable period, primarily depend on continued Western support.
